Jeff Hardy’s scheduled pre-trial hearing in Florida for DUI-related charges on Thursday did not take place as planned.
His defense team filed for a continuance, according to court documents obtained by Pwinsider.com, with the pre-trial hearing now scheduled for December 21. The documents state that Hardy must appear in court for the hearing. On June 28, Hardy entered a written not guilty plea with the court.
Hardy’s attorneys previously waived his right to a speedy trial and asked that a hearing scheduled for this past July be pushed back 60 days to help with his defense. The hearing was delayed in October after his attorney filed a last-minute motion to provide extensive mitigation materials to the State’s counsel and for both sides to negotiate a potential pretrial resolution.
If this resolution is reached, a trial will be avoided, and Hardy will enter into a plea agreement.
Hardy was arrested in June and charged with DUI (Alcohol or Drugs), third offense within ten years, driving while license canceled/suspended/revoked, and violation of driver’s license restrictions.
Under Florida law, the primary charge is a felony punishable by up to five years in prison if Hardy is convicted, while the others are misdemeanors. He has entered a not guilty plea.
