Despite the fact that WWE had a fan lawsuit filed against them by Marvin Jackson alleging that he was injured while attending WrestleMania 38 in Dallas dismissed, the company is not finished with it.
He claimed that the pyrotechnics used in the production of WrestleMania 38 caused him to lose hearing in his left ear while he was a “invitee” to the event. The lawsuit was filed in Texas in January.
He requested a jury trial in order to receive financial relief totaling more than $1,000,000, including any and all damages, fines, costs, expenses, prejudgment interest, and legal fees.
The United States District Court for the Northern District of Texas, Fort Worth Division, received his notice of appeal on May 11, according to court records, PWInsider reports.
This comes after US District Judge Mark T. Pittman granted WWE’s earlier request to transfer the legal dispute from US District Court to arbitration.
The court previously rendered a prejudiced dismissal of the case. This usually indicates that the case cannot be reestablished in the same court.
